Basic Garden Fence Laws Published on Friday, 26 March 2010 A beautiful garden fence can enhance the look of your home and can protect your lovely plants. But before you begin building one, you have to learn more about the different zoning and fencing laws in your area. If you don't, all your hard work might be put to waste since certain laws might require you to remove your garden fence. Read on to find out more about the basic garden fence laws in the UK. 1. Check the boundaries of you and your neighbour's lands. You can get copies of titles of deeds at the Land Registry or at www.landreg.co.uk. The plans of your property should clearly show boundary lines. If you see “T” marks on the plan, these point to the direction of the owner who has to keep a wall, fence or hedge. An “H” mark indicates a party wall. 2. Inform your neighbour about your plans for a fence. Don't wait for disputes-talk with your neighbour first about your plans for putting up a garden fence, so you can iron things out such as boundaries. 3. When planting a hedge instead of a garden fence, make sure that you plant it at least 1 metre inside your boundary line. This is to ensure that your hedge does not encroach on your neighbour's space when it grows. 4. Get permission first. This is so you do not have restrictions on your fence height. If you get planning permission, you can create a fence up to any height but without permission, you are only allowed a fence up to 6'6”. 5. Get legal advice. It's always best to be safe than sorry. When in doubt, consult with a lawyer or a landscape architect. They would know more about the different garden fence laws. Don't get into nasty legal disputes or fights with your neighbours regarding a simple garden fence. Make sure you're following the basic garden fence laws when building one.
